We have long represented companies involved in the credit card processing and elecronic payments industry, providing a wide range of counseling and litigation services, both domestically and internationally.
We possess a strong, practical knowledge of the myriad issues confronting Independent Sales Organizations (“ISOs”), Internet Payment Service Providers (“IPSPs”), Acquiring banks, Aggregators and High Risk Merchants, and are keenly aware of the key players in the industry and their respective roles. As a result, we understand the risks inherent in the various relationships among processors and financial institutions, and use this knowledge to protect our clients’ interests in negotiating and drafting their commercial agreements, whether related to marketing, services, revenue sharing, or processing. We also counsel our clients on compliance review issues for legal, regulatory and card association purposes.
Combined with our proven ability as commercial litigators, we are uniquely qualified to handle any dispute that may arise. We regularly assist our clients in prosecuting and defending claims concerning nonpayment or mishandling of funds, credit card fraud, chargebacks, reserve accounts, breach of contract, and other issues, throughout the state and federal courts system, in arbitrations and mediations, and internationally.
Our experience includes:
- Counseling ISOs, Acquiring Banks and IPSPs regarding commercial agreements and regulatory and card association compliance issues
- Drafting merchant agreements for Acquiring Banks and ISO’s
- Negotiating contracts in the bank card industry
- Representing ISO’s, Acquiring Banks, IPSPs, Internet Gateway Processors, Aggregators and Merchants in internal industry disputes
- Representing Internet commerce merchants in credit card processing disputes against Acquiring Banks and card associations both domestically and abroad, involving chargeback disputes, improper reserve allocations, and mishandling of funds
